Entity Borrowing

DSCR Loans in an LLC: What Investors Need to Know

An LLC can hold title and borrow under many DSCR programs. It usually does not eliminate guarantor credit review, recourse or the need to document every owner.

Can an LLC get a DSCR loan?

Yes. Many DSCR lenders allow—and in some states or programs require—the property and loan to close in an LLC, corporation or other eligible entity. The lender still typically underwrites the property, reviews the guarantor’s credit and liquidity, and requires one or more owners to sign a personal guaranty.

Do not confuse entity vesting with no personal liability. An LLC may separate property ownership from an individual, but a personal guaranty can still make the signer personally responsible for the debt. Entity structure also does not automatically keep the loan off every personal credit report or protect personal DTI in every future underwriting system. Ask the lender and your legal/tax advisers.

The five separate LLC questions

QuestionWhy it matters
Who owns the property? The deed may vest in the LLC rather than the individual.
Who is the borrower? The note may name the LLC, but documents vary by lender and state.
Who guarantees the loan?A personal guaranty can create individual repayment liability despite entity borrowing.
Whose credit is used?Lenders may use the managing member, majority owner, highest owner or all guarantors under program rules.
Who must document liquidity?Down payment and reserves may need to be sourced from the entity, guarantor or an allowed combination.

Which DSCR lenders allow entity borrowing?

Visio explicitly states that its DSCR loans can close under an LLC, corporation or limited partnership. Its public site also notes that entity borrowing is required in certain states. A&D, FlexPoint, Lima One, HomeAbroad, Ziffy and several other directory programs publish or have supplied entity-compatible options. Exact entity types and guarantor rules vary.

What documents should the LLC expect to provide?

A newly formed LLC may still qualify, but its documents must be complete before closing. Name mismatches between the contract, title, insurance, appraisal and entity documents create avoidable delays.

Whose credit score governs?

There is no universal rule. Some programs use the primary guarantor; others review every owner above a stated ownership threshold or use the lowest qualifying score among required guarantors. This is one of the next fields DSCRDeals intends to structure more precisely: ownership percentage, required recourse and which owner’s credit controls.

Does an LLC remove personal income documentation?

The DSCR structure—not the LLC by itself—is what generally removes traditional personal-income qualification. Lenders still evaluate credit, background, liquidity, experience and the property’s rent-to-payment coverage. “No tax returns” does not mean “no borrower underwriting.”

Buying in the LLC versus transferring later

If entity ownership is the plan, forming and documenting the LLC before contract and closing is usually cleaner. Transferring a personally owned financed property into an LLC later can trigger lender-consent, insurance, title, transfer-tax and due-on-sale issues. Visio specifically warns that an existing loan may contain a due-on-sale clause. Do not deed a financed property into an LLC without reviewing the loan documents and obtaining legal guidance.

Series LLCs and layered entities

Series LLCs and parent/subsidiary structures can complicate verification. A lender must confirm that the exact borrowing entity exists, is authorized and can hold title. Visio notes that improperly documented series can be difficult or impossible to fund. Complexity should earn its keep; do not build an elaborate structure that the lender, title company and insurer cannot verify.

FAQ

Can a new LLC qualify for a DSCR loan?

Often, yes. The lender will still require valid formation documents, authority to borrow, a qualifying guarantor and acceptable funds.

Does an LLC DSCR loan require a personal guaranty?

Usually. OfferMarket, for example, publicly identifies a personal guaranty as part of its DSCR structure. Non-recourse options are specialized and should never be assumed.

Will an LLC loan appear on personal credit?

Reporting practices vary. Entity borrowing and a personal guaranty are separate from credit-bureau reporting. Ask the lender how the loan and any default are reported.

Can multiple owners use one person’s credit?

Possibly, but program rules determine which owners must guarantee and whose score governs. Disclose the complete ownership structure at the start.

Should I transfer my rental into an LLC before refinancing?

Not without reviewing the existing loan, title, insurance, taxes and lender requirements. A transfer can trigger a due-on-sale clause or other costs.
